Article 1 : Préambule

NBD S.a.r.l. aims the sale of biking materials and accessories.

Any order placed by a customer on the www.rczbikeshop.com website automatically implies the acceptance of these terms and conditions by the customer. 

Article 2 : Definitions and Imprint

I order to guarantee the maximum possible transparency when reading the NDB S.a.r.l terms and, you will find below the precise definition of some terms that will appear later in articles.

Article 3 : Subject

The present T&C set out the contractual relations between NBD S.a.r.l. and its customers. The T&C define the rights and obligations of the Parties for the duration of the relationship between NBD S.a.r.l. and its customer.

NBD S.a.r.l. reserves the right to modify the present terms and conditions at any time.

 

Article 4 : Products

All the products offered on the www.rczbikeshop.com website comply with safety standards and comply with current legislation.

The consumer remains free and responsible for his purchases on the site.

All products sold on www.rczbikeshop.com are presented with the greatest care. However, please note that the photos are not contractual. We invite you to refer to the product description. In addition, human errors may occur or changes may be made by our suppliers without them informing us. In addition, the technical information we put on our product sheets is that provided by our suppliers.

Due to the multitude of brands and models we offer and the technical complexity of some products, you can send us an email to info@rczbikeshop.com for any requests for clarification or advice. However, please note that the information we have is often limited. As these are private sales, we do not have the products in stock to check. Nor can we provide you with information on measurements or weights.

For any purchases of clothing or shoes, we advise you to try them in store beforehand, then order them. Indeed, sizes and sizing can vary according to the brands. A size M of one brand may, for example, correspond to a size L for another. This is also the case for shoes. RCZ cannot under any circumstances be held responsible in the event of an error in your size or fit.

The customer remains solely responsible in the event of a purchase not adapted to his needs or the purchase of an item incompatible with other items purchased on www.rczbikeshop.com or other items already in the customer's possession.

Under no circumstances may NBD S.àr.l. be held liable. For any request for return, please consult articles 10, 11 and 12.

Article 5 : Prices

Thanks to your IP address geolocation, You are directly connected on the website which provides you the price in the correct currency and with Country VAT where you are connected. We would like to offer our customers the maximum possible transparency on our prices and we do our best to provide you from the outset a correct price including taxes and VAT. If however the IP geolocation does not work or if you prefer to be delivered in another country than the one your are located at the time you order, you can modify your preferences at any time in the top right navigation bar.

Prices listed on  www.rczbikeshop.com never include shipping charges. The shipping cost will be Le prix pour la livraison will appear as soon as you have choosen your suitable delivery mode. You can also estimate shipping cost at any time in the “My Cart” section, or you can alow be informed about our price policy in the “Shipping Charge” section.

For orders placed within the European Union, prices include VAT paid to the various states according to the current rate in the country of destination of the order (20% for France, 17% for Luxembourg, etc.) or according to the Luxembourg VAT rate (17%) if we have not yet reached the threshold in the country concerned.

VAT is not charged on orders to countries outside the European Union (Switzerland, Andorra, Ukraine,) or to regions not covered by VAT as the DOM-TOM. Orders for these destinations will not be billed with VAT. If taxes or local customs charges were applied, they remain on the client. Please note that taxes, import fees and customs fees are out of our control. We invite you to contact the customs authorities of your country for more information.

Products will be invoiced on the basis of the rates in force at the time the order is recorded. Ordered products remain property of NBD S.a.r.l. until full payment of the invoice. We reserve the right to suspend or cancel any order in the event of non-payment of any amount due by the consumer.

Selling prices of the different products might be modified at any time and without any advance notice from NBD S.a.r.l.

 

Article 6 : Register on the website

When you order, the customer will be asked to register if he wants or order without registering. If the customer decide to register, he will be asked to complete a customer form with several information and to create a password. Thes informations are saved on NDB S.a.r.l. servers and will be treated as confidential; and they won’t be in any case disseminated to third parties.

The customer has access to the “My Account” section on the website in which it is possible for him to modify his personnal information and his password. The customer is the only responsible for its information on its Customer account and its password. NBD S.a.r.l. cannot be held responsible ne pourra pas être tenu responsable in the event of a loss or  dishonest or malicious use. In the event the customer forgot its password, the customer has a “Forgot your Password” section which enables it to receive an email with its username.

NBD S.a.r.l. informs its visitors that one or several cookies which not contain any personnal information, may be installed on its hard disc in order to ensure its identification. Cookies are small text files stored on visitors computer and which enable RCZbikeshop.com to remember visitor’s country, language and currency, and also for example to show articles that were placed on my cart during the last connection. All of this aims to make your website navigation as pleasant as possible.

Article 7 : Order

Any order automatically generates an order confirmation sent by email to the email address provided by the customer.

NBD S.a.r.l. reserves the right to contact the customer if there is a doubt on the order content (validity of the credit card used, substantial quantity...).

Article 8 : Payment

Depending on the country, we offer our customers the possibility to pay by credit card (VISA / MasterCard / Maestro), Paypal and/or bank transfer.

Here is the list of countries for which we offer payment by card, Paypal and bank transfer:

Austria, Belgium, Bulgaria, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland and Ukraine.

For all other countries in the world, we only offer payment by bank transfer.

Payments by Credit Card and Paypal are made through the Paypal platform (even if you do not have a Paypal account). If you wish to pay by credit card from Paypal, we invite you to choose the option "Paypal", then "I don't have a Paypal account". A classic card form will appear and you can order safely.

 For all our new customers with an order over 500 euros, and ordering by credit card, we systematically block the order and request a copy of the identity card, as well as a proof of residence. Indeed, in the past, we have had many credit card frauds, and we are obliged to apply additional control. We will unblock your order after checking these documents. If we do not receive these documents, the order will be cancelled and refunded.

For most orders with discount codes, we do not accept payment by bank transfer.  Indeed, only 30% of the orders by bank transfer are actually paid. This blocks
 products for many days and other customers are not able to benefit from promotions that are limited in time. If you do not have a credit card, please open a Paypal account and pay by Paypal.

We do not accept payment by cheque to avoid additional delays related to the sending, receipt and processing of cheques.

All your purchases must be paid only in euros.

For security reasons, we will contact you if we need further information.

Article 9 : Delivery

The deadline for the reception of your order depends on your choice of delivery method:

- Point Relais Delivery:


The average delivery time is 4 to 6 business days from the time the package has left our facilities and collected by Global Relay. Your point relay will notify you by email when the package is available.

Packets collection by Global Relay takes place every working day (except Monday), so all orders validated on our website from Friday to Monday will be collected by Mondial Relay the following Tuesday.

- Home delivery by Colissimo or UPS:


The average delivery time is 2 to 4 working days for Europe (for countries outside of Europe 6-10 working days) from the time the package has left our facilities and collected by the carrier .

This leadtime is provided for information only and any potential delay should not give rise to the payment of any compensations, nor any deduction or cancellation of the order by the customer.


Products are delivered to the address provided at the time the customer perform its order (Drop-off point or private address).
Any anomaly concerning the shipment shall be imperatively indicated on the airway bill and together with the customer signature.
NBD S.a.r.l. won’t be responsible for mistakes on the delivery address at initial information capture by the customer.

IMPORTANT: In addition to the products available immediately (with the mention "in stock" on the product sheet), we offer products in PRIVATE SALE, i.e. subject to a delay before shipment. These announced delivery times (whether indicated on the product sheet or in the newsletters) generally vary from 20 to 30 working days, with exceptions of several weeks or even several months for products such as DT SWISS wheels, in addition to the standard delivery times mentioned above.

This deadline is provided as an indication and any possible overrun will not give rise to damages, nor to a retention or cancellation of the order for the customer.

The products are delivered to the address indicated by the customer at the time of ordering (relay point or private address). Please note, however, that we have several stocks in France/ Spain and Luxembourg). Therefore, orders can be sent with a different sender than the one chosen (but always door-to-door or pickup point as specified in the order). Since the rates indicated and the quality of the services offered by the shippers are relatively similar, no reimbursement of shipping costs is possible.

Any anomaly concerning the delivery must be indicated on the delivery note and be accompanied by the customer's signature.

In the event of an error in the wording of the delivery address at the time of initial entry of the information by the customer, NBD S.à.r.l. cannot be held liable. If the package is returned to us, we will refund the order less shipping costs.

Article 10 : Change of opinion after the delivery

I have already received the order. Due to a change of opinion, I would return one or more products, or the whole order. How should I proceed?

 The withdrawal period for a change of mind is 14 days after receipt of the order. After this period, no claims will be accepted.

A. If you want to return one or more products of your order, the procedure is as follows:

We specify that we do not exchange products, and all returns will be subject to refunds (by bank transfer, Paypal, loyalty points or on the card linked to the transaction)

Please note that on product returns following a change of opinion or an error on your part, a flat-rate fee will be charged when you are refunded by bank transfer or card related to the transaction:

* 5 € for the return of one or more standard components

* 7 €: return of a single wheel

* 10 €: fork or pair of wheels

* 20€ : return of a frame

* 50 €: return of a bike

After receiving your package, please send us an email (or fill in the contact form) with the following information:

- The order number

- The first and last name mentioned on the order

 - The product(s) you wish to return

 - The reason for the return

 Please note that you are responsible for the return shipping costs.

 

IMPORTANT: Any package returned WITHOUT obtaining a return number in advance will be refused and the customer will be held responsible. We cannot be held responsible for any damage or loss of the package.

 

 

B-If you wish to return a complete order already shipped, please follow the steps below:

We specify that we do not exchange products, and all returns will be subject to refunds (by bank transfer, loyalty points or on the card linked to the transaction)

 

Please note that on product returns following a change of opinion or an error on your part, a flat-rate fee will be charged when you are refunded by bank transfer or card related to the transaction:

* 5 € for the return of one or more standard components

* 7 €: return of a single wheel

* 10 €: fork or pair of wheels

* 20€ : return of a frame

* 50 €: return of a bike

After receiving your package, please send us an email (or fill in the contact form) with the following information:

- The order number

- The first and last name mentioned on the order

 - The product(s) you wish to return

 - The reason for the return

 

As soon as we receive your request, we will send you by email the return number and the procedure to follow.

 

IMPORTANT: Any package returned WITHOUT obtaining a return number in advance will be refused and will remain the responsibility of the customer. We cannot be held responsible for any damage or loss of the package.

Please note that you are responsible for the return shipping costs.

Special case: However, if you have decided to refuse the package (at the relay point or the delivery person): please note that a flat-rate fee of 35 Euros will be deducted from your refund.

 

Article 11 : After-Sales Service and Warranty

A- I received my package and at the opening: one or more products do not conform to my order or they arrived defective or flawed. What shall be done about it?

The deadline for complaints is 15 days after receipt of the order. After this period, no claims will be accepted.

Please send us an email (or complete the contact form) with the following information:


- The order number
- Photos
- The explanation of the problem.
- Product damaged or wrong

Once we receive your request, we will send by mail the "return number" and the procedure you have to follow.
We are committed to return a product or a refund to you as soon as possible

Regarding shipping costs, we wanted you to know that shipping costs will be paid by us only if we are wrong

 

Moreover, the returning costs from you to us are at your charge, and  the shipping cost from us to you are at our expenses if the guarantee has been accepted by the manufacturer or distributor.

IMPORTANT: All packages without return number previously sent by us will be rejected. The returned products are under the responsibility of the costumer. We are not responsible for the deterioration or loss of the order.

 

By following these few recommendations, we are committed to make every effort to satisfy you. Your satisfaction is our greatest reward.

Note : For our after-sales service, please send us the products without accessories, otherwise, it is possible that these are not given back.
RCZ cannot be retained liable if accessories are missing.

Concerning the shipping costs, we would like to inform you that the shipping costs will be at our expense only if we have made a mistake.

On the other hand, the costs will be borne by the customer if it is a warranty issue and when the product is repaired, we will bear the return costs if the warranty has been accepted by the manufacturer or distributor.

Note: In case of after-sales service, please return the products without accessories, otherwise there is a risk that they will not be returned. RCZ declines all responsibility in the event of non-return of accessories.

B- Under the warranty, a product is defective after a few weeks or months, what should I do?

The warranty period is 3 months after receipt for wear parts (bearings,...) and 2 years for the rest.
Some of the bicycles we sell are covered by the lifetime warranty. It is the customer's responsibility to check with the brand and register their bike online. In the event of failure to
 register, RCZ cannot be held responsible.

If this condition is met, please send us an email (or fill in the contact form) specifying the following information:

- the order number

- The photos

- The explanation of the problem

- The product that is wrong.

As soon as we receive your request, we will send you by email the return number and the procedure to follow after confirmation of our after-sales service.

The return costs will be charged to the customer if it is a warranty issue and when the product is repaired, we will take care of the return costs if the warranty has been accepted by the manufacturer or distributor.

Note: In case of after-sales service, please return the products without accessories, otherwise there is a risk that they will not be returned. RCZ declines all responsibility in the event of non-return of accessories.

If the supplier considers that the damage is not covered by the warranty, a repair quotation may be issued. If you accept it, the repair will be done once the payment has been received. If you do not accept it, the product will be returned under the same conditions as returned.

Article 12 : Our newsletter

We send out emailing campains to our customers on a regularly basis to keep them up to date concerning the sales and other promotional offers in our online shop (discount codes, special campains on product groups and so on).

We automatically add all customers that create an account with us to the distribution list of our email newsletters. Should you not want to receive such information, please use the Unsubscribe link that we include in each of our promotional emails we send you. 

Article 13 : Protection of Privacy and Personal Data

Any personal data collected by NBD S.a.r.l. as part of commercial activities with its customersd will be reflected in its files and will only be used for own purposes in a context defined by the contract between the two parties. In accordance with the provisions of the 8 December 1992 Act on the protection of private life with respect to the processing of personal data, the customer is allowed to consult and rectify the concerned data if need be.

Article 14 : Applicable Law and Competent Court

Any dispute between NBD S.a.r.l. and its customers is governed by the Luxembourg law as the  NBD S.a.r.l. headquarters is located in Grand-Duchy of Luxembourg.
Inthe event of dispute, parties will endeavour to solve this matter amicably. In the absence of such agreement, Luxembourg courts et tribunals shall have sole jurisdiction.

In case of linguistic doubt, the French version of these Terms and Conditions shall prevail.
 

Article 15: Terms of sales for forks/frames/wheels/ brakes:

Fork delivery:

All forks are delivered without air pumps.

Wheels delivery:

The wheels are delivered without wheelbags, rim tape, valves, and quick
releases (if not mentioned differently in the product description).
Wheels with front 15mm and rear 12mm axle are delivered without axle.
Wheels are sold in the configuration mentioned in their title. For
example, a pair of 12*142 wheels will not have the adaptor to transform
them into a 9mm. Shimano Centerlock bolts are not delivered with Shimano
wheels.

Frame delivery:

The derailleur hanger is delivered disassembled in the package.
Frames are sold bare: the derailleur hanger is included in the package,
but the frame is delivered without cable guide, collar, headset...

Brake delivery:

 The brakes are sold without any accessory, ready to use and bleeded. All accessories such as screws and bolts, adaptors, cables or discs ar not included, except if mentioned differently in the product description. The brakes are usually delivered bleeded by our suppliers. However, in some occasions the brakes might need bleeding. 

Terms and conditions for bikes' sale:

All our bikes are mounted at 90%. This means that general fitting and/or adjustements might be necessary. Please note that they are delivered without pedals. Some adjustements might be necessary (brakes bleeding, ...) You are advised to let a professional in the cycling sector do these adjustements and verifications.

All products are sold following the above conditions. If an accessory is delivered with the product, then this will be mentioned in the
description. If nothing is mentioned, nothing extra is included.

Article 16: "Crazy Prices" Offers ( - 3.99 €)

Because of the very competitive prices, we propose this product as it is on the picture. The text is there for information only and cannot be considered contractual.
This product cannot be shipped back for refund nor be exchanged.

Article 17: Private Sales

In addition to the products in stock immediately available, we offer products sold on private sale, which are subject to a delay before shipment.

As we sell the products before ordering them from suppliers, this implies that:

- the products are subject to a more or less long delay before shipment (generally 25/30 Days, or even several weeks or several months for some products)

- we do not have any additional information on these products, other than that already mentioned on the product sheet

- products may not fully comply with the advertisement. In this case, we proceed to a full refund or the shipment of another substitute product after agreement with the customer

- the products may ultimately be missing after the waiting period. In this case, we will refund the full order or the missing product if the rest of the order can be sent.
